“Confirmation with ARH reveals that the “despacho” oversimplified the
situation and IN ADDITION to the matters below one needs to visit the

and then search your location using the search function to ensure that the
site of the furo is NOT within an area marked with any cross hatching.
Thus to be exempt from registration/communication the furo must be:
i. In use pre 01.06.2007;
ii. Less than 5cv:
iii. Not within any conditional area.

Please note that there was clarification made to the 2007 Lei da Água and
whilst all fossas that drain into the surrounding soil must be registered
with the relevant authority which in the case of the Algarve is the
Administração da Região Hidrográfica do Algarve (ARH), furos or wells sunk
and in use before 1st June 2007, with a pump less than 5 cv do not need to
be registered (thus obtaining a titulo de utilização).
The owners may opt to communicate/inform the use of the furo/well but this
is purely on a voluntary basis and might be made if the owner wishes to
ensure that an adjoining, and possibly conflicting, furo or well is not
sunk.
All furos/wells sunk and in use after 01 June 2007 should be communicated
to the ARH but there is no fee payable.
All furos/wells with an extraction means above 5 cv, whether in use before
or after 01 June 2007, must register under the terms of the Lei da Água
and obtain a titulo de utilização, permit or authorization whichever is
the case.
